TICKET PURCHASE TERMS & CONDITIONS

In these terms and conditions (“Terms”), St. John's Comedy Fest and/or Newfoundland Screech Comedy Fest, as applicable, shall be collectively referred to as “Newfoundland Screech Comedy Fest”.

These Terms apply to each agreement for the purchase of a ticket or tickets for Newfoundland Screech Comedy Fest, events (the “Agreement”). In entering into an Agreement, the ticket holder (the “Holder”) expressly agrees to be bound by these Terms, which form an integral part of the Agreement, and agrees that these Terms apply to all tickets purchased pursuant to the Agreement. Newfoundland Screech Comedy Fest reserves the right to unilaterally amend from time to time the terms and conditions governing all tickets, and such amendments shall be effective upon written notice to the Holder.

OWNERSHIP

The person whose name is indicated in the Agreement shall be deemed to be the Holder. Newfoundland Screech Comedy Fest will deal only with the Holder in all matters pertaining to the tickets purchased under the Agreement. Should a Holder wish to have someone else named to handle such matters, written authorization must be submitted by the Holder to Newfoundland Screech Comedy Fest for approval.

REVOCABLE LICENSE AND RESTRICTIONS

All tickets purchased pursuant to the Agreement are revocable licenses, any and all of which licenses may be revoked by Newfoundland Screech Comedy Fest, in its sole discretion, at any time and for any reason.

Re-sale or attempted re-sale by the Holder of any of the Holder’s tickets is prohibited. The Holder may not sell, give away, donate, sublicense, lease, lend, dispose of in any manner, or otherwise part possession with, any of the Holder’s tickets in connection with any promotion of merchandise or services of any kind or for any other commercial purposes whatsoever.

In the event of failure by the Holder to comply with these Terms, Newfoundland Screech Comedy Fest may take whatever action it deems necessary including the cancellation of any and all tickets of the non-compliant Holder, without compensation and without prejudice to the commencement of legal action against the Holder.

LOSS OF TICKETS/REFUNDS

Tickets cannot be replaced if lost, stolen or destroyed, and is valid only for the event and seat for which it is issued. This ticket is not transferable or redeemable for cash. It is unlawful to reproduce this ticket in any form. Unless indicated otherwise, all ticket prices for events that occur in Canada are stated in Canadian Dollars. Tickets are non-refundable except in cases where the event has been fully cancelled by Newfoundland Screech Comedy Fest, in which case refund details will be posted on our website next to cancellation announcement.

Any refunds by Newfoundland Screech Comedy Fest will be for the ticket's face value paid (or, if a discounted ticket, then instead the discounted ticket price paid) only. Facility fee, convenience fee or service fee will not be refunded. If a refund is issued, it will be issued using the same method of payment that was used to purchase the tickets. If a credit card was used to make the refunded purchase, then only that actual credit card will receive the credit for the refund. Policies set forth by event providers prohibit us from issuing exchanges or refunds after a ticket has been purchased or for lost, stolen, damaged or destroyed tickets.

PAYMENTS

All sales are final. Deposit and ticket payments are non-refundable. Ticket prices are stated in Canadian dollars.

Payments returned by the bank will result in a $20 handling fee which will be charged to your account.

In the event a Holder defaults on making any payment under the Agreement Newfoundland Screech Comedy Fest may cancel any and all tickets of the Holder without compensation.

If the amount you pay for a ticket is obviously or grossly incorrect regardless of whether because of an error in a price posted on this web site or otherwise communicated to you, or you are able to order a ticket before its scheduled on-sale or presale date or you are able to order a ticket that was not supposed to have been released for sale, then: Newfoundland Screech Comedy Fest will have the right to cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of whether due to human error or a transactional malfunction of this web site or other Newfoundland Screech Comedy Fest operated system.

Governing Law

These Terms shall be governed by the law of the Province of Newfoundland & Labrador, without regard to its conflict of laws provisions. Any action or proceeding arising out of or relating to these Terms must be brought in the courts of the Province of Newfoundland & Labrador. The Holder knowingly, voluntarily and irrevocably submits to the exclusive jurisdiction of the courts located in St. John's, Newfoundland in any such action or proceeding and waives any objection it may now or hereafter have to venue or to convenience of forum.,m,,m
